These Terms of Use (“Supplemental Terms”) govern your access to and use of the RentCircle mobile application, website, and related services (collectively, the “Service”), operated by Symph, Inc. (“RentCircle,” “we,” “us,” or “our”).

These Supplemental Terms apply in addition to the standard end user license agreements and terms provided by the platform from which you downloaded the RentCircle app.

1. Relationship to Platform Standard EULAs

Apple (iOS)

If you access RentCircle on an Apple device, your use of the Service is governed by Apple’s Standard End User License Agreement (“Apple Standard EULA”), available at:

Android (Google Play)

If you access RentCircle via Google Play, your use of the Service is governed by Google Play’s Terms of Service, available at:
https://play.google.com/about/terms/

These Supplemental Terms are intended to supplement, and not replace, the applicable platform terms. In the event of any conflict:

• Apple’s Standard EULA controls for iOS users.
• Google Play’s Terms control for Android users.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use RentCircle. By accessing or using the Service, you confirm that you meet these requirements.

3. Account Registration and Responsibility

Certain features require account registration. You agree to provide accurate, current, and complete information and to keep your account details up to date. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

4. Subscriptions and Payments

RentCircle may offer auto-renewable subscriptions that provide access to premium features. Subscription pricing, duration, and features are displayed clearly in the app prior to purchase.

Apple (iOS)

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Subscriptions are managed through Apple ID account settings.

Android (Google Play)

• Payment is charged to your Google Play account upon confirmation.
• Subscriptions automatically renew unless canceled through Google Play subscription settings.
• Billing, renewals, and refunds are handled by Google Play in accordance with its policies.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe intellectual property, privacy, or other rights
• Engage in fraudulent, deceptive, or abusive behavior
• Distribute malware, spam, or harmful content
• Interfere with the security or operation of the Service

6. Content and Intellectual Property

All content, software, trademarks, designs, and materials provided through RentCircle are owned by Symph, Inc. or its licensors and are protected by applicable intellectual property laws. No rights are granted except as expressly stated.

7. Privacy

Your use of RentCircle is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

8. Termination

We may suspend or terminate your access to the Service if you violate these terms or misuse the Service. Upon termination, your right to access the Service will immediately cease.

9. Disclaimer of Warranties

To the maximum extent permitted by law, RentCircle is provided on an “as is” and “as available” basis, without warranties of any kind.

10. Limitation of Liability

To the fullest extent permitted by law, Symph, Inc., its affiliates, officers, employees, and agents shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Service.

11. Governing Law

These Supplemental Terms are governed by the laws of the jurisdiction in which Symph, Inc. is incorporated, without regard to conflict of law principles.
